  • Order: A purchase made by a customer through the Platform

2. Nature of the Platform

PhotoFrameIndia is a multi-vendor marketplace.
We do not manufacture, store, or own the products listed unless explicitly stated.

  • Vendors are responsible for their products

  • PhotoFrameIndia acts as a technology and facilitation platform

  • Each vendor operates independently

3. Account Registration

Customers

  • You must provide accurate and complete information

  • You are responsible for maintaining account confidentiality

  • Any activity under your account is your responsibility

Vendors

  • Vendor registration is subject to approval

  • We reserve the right to approve, reject, suspend, or terminate vendor accounts

  • Vendors must provide accurate business, bank, and tax details

4. Products & Listings

  • Vendors are solely responsible for:

    • Product descriptions

    • Images

    • Pricing

    • Stock availability

    • Legal compliance

  • PhotoFrameIndia reserves the right to:

    • Review, approve, edit, or remove any listing

    • Suspend vendors for misleading or illegal listings

5. Pricing & Payments

Customer Payments

  • All payments are processed through secure third-party gateways (e.g., Razorpay)

  • Prices displayed are inclusive/exclusive of taxes as mentioned

  • Payment confirmation depends on the payment gateway

Vendor Earnings

  • Vendor earnings are calculated after platform commission

  • Payment gateway fees may be borne by the platform unless otherwise specified

  • Vendor payouts are processed through manual withdrawals

6. Commission & Fees

  • PhotoFrameIndia charges a commission on each successful sale

  • Commission percentage is defined in vendor agreements or dashboard

  • Commission may vary by vendor, product, or category

  • We reserve the right to revise commission structures with prior notice

7. Shipping & Delivery

  • Vendors are responsible for packing and shipping products

  • Delivery timelines are estimates, not guarantees

  • PhotoFrameIndia is not liable for courier delays, damage, or loss

  • Customers must report damaged items within the specified timeframe

8. Cancellations & Refunds

Cancellations

  • Orders may be cancelled before shipment, subject to vendor policies

  • Custom or made-to-order products may not be cancellable

Refunds

  • Refund eligibility depends on vendor policy and product type

  • Approved refunds are processed via the original payment method

  • Processing time depends on banks/payment gateways

9. Vendor Withdrawals

  • Vendors can request withdrawals once eligible balance is available

  • Withdrawals are subject to:

    • Minimum withdrawal amount

    • Withdrawal delay period

    • Admin approval

  • PhotoFrameIndia does not guarantee instant payouts

10. Taxes & Compliance

  • Vendors are responsible for:

    • GST registration (if applicable)

    • Tax invoicing

    • Tax compliance

  • PhotoFrameIndia is not liable for vendor tax defaults

  • Customers are responsible for any applicable local taxes

11. Intellectual Property

  • All platform content (logo, branding, design, text) belongs to PhotoFrameIndia

  • Vendors retain rights to their product images and descriptions

  • Unauthorized copying or misuse is prohibited

12. Prohibited Activities

Users and vendors must not:

  • Post false or misleading information

  • Sell illegal, counterfeit, or restricted items

  • Abuse platform systems or other users

  • Attempt to bypass commissions or payments

  • Upload malicious code or spam

Violation may result in account termination.

13. Limitation of Liability

PhotoFrameIndia shall not be liable for:

  • Vendor product quality issues

  • Delivery delays or failures

  • Indirect or consequential damages

  • Losses due to misuse of the Platform

Maximum liability is limited to the value of the order in dispute.

14. Indemnification

You agree to indemnify and hold PhotoFrameIndia harmless from:

  • Claims arising from your use of the Platform

  • Vendor disputes

  • Legal non-compliance by vendors or users

15. Account Suspension & Termination

We reserve the right to:

  • Suspend or terminate accounts without prior notice

  • Remove listings or restrict access

  • Withhold payouts in case of disputes or fraud

16. Privacy

Your data is governed by our Privacy Policy.
By using the Platform, you consent to data collection and usage as outlined there.

17. Modifications to Terms

  • We may update these Terms at any time

  • Changes take effect upon posting

  • Continued use implies acceptance

18. Governing Law & Jurisdiction

These Terms are governed by the laws of  India.
All disputes are subject to the jurisdiction of Guwahati High Court.
